Clause 13

Protection of personal data (GDPR / LOPDGDD)

Data controller

Funiglobal Development, S.L. (Tax ID (CIF): B22370902; registered office: Calle Poetisa María Zambrano, 31, Edificio WTCZ – Torre Este, Floor 16, 50018 Zaragoza) acts as the controller of the personal data of the Buyer's representatives, employees and contacts within the framework of this commercial relationship.

Purposes and legal bases

Personal data will be processed for the following purposes:

Purpose of processing Legal basis (art. 6 GDPR)
Commercial management, invoicing, order dispatch and collection of payments Art. 6.1(b): performance of the contract
Compliance with tax and accounting obligations Art. 6.1(c): legal obligation
Commercial communications and the building of B2B marketing profiles Art. 6.1(f): legitimate interest of the Supplier in fostering the loyalty of professional customers, with the right to object at any time (art. 21 GDPR)
Transactional communications and incident handling Art. 6.1(b): performance of the contract

Data retention

Data will be retained for the duration of the commercial relationship and, once it has ended, for the legally required periods:

Tax and commercial obligations:
· Art. 30 of the Commercial Code — 6 years
· Law 58/2003, General Tax Law — 4 years

Data processed on the basis of legitimate interest will be retained until the data subject exercises their right to object.

Rights of data subjects

Data subjects may exercise the following rights by writing to rgpd@funidelia.es:

  • Access
  • Rectification
  • Erasure
  • Objection
  • Portability
  • Restriction of processing

They are also entitled to lodge a complaint with the Spanish Data Protection Agency: www.aepd.es

International transfers

Should the Supplier use data processors or tools that entail international transfers of data outside the European Economic Area, such transfers will be carried out under the safeguard mechanisms provided for in Chapter V of the GDPR:

· Adequacy decision of the European Commission
· Standard contractual clauses (SCCs)
· Other appropriate safeguards under the GDPR

The Buyer will be informed of this by means of the privacy notice available on the Funidelia Pro platform.
